The legal framework established in the Community legal order for GMOs draws a clear distinction between the “environmental” impacts of GM cropping and its “economic” impacts. The potential economic impacts (such as the maintenance of organic certification) are dealt with by the measures on “coexistence”. Potential environment impacts, such as the impact on biodiversity and wildlife, are intended to be dealt with primarily by European environmental legislation . This paper addresses the environmental liability mechanisms established in EC law. It idenitfies a number of shortcomings and potential problems in applying the new EC Environmental Liability Directive to GMO releases.
