| We intend to explore the complexity of the relationship between the right of privacy and tort law by looking at concrete cases collected from ten European legal systems, highlighting the main features of the standard of protection awarded, with a particular emphasis on the horizontal effect of the analysed right. We examine the horizontal effect of both constitutional rights, as laid down in the respective national constitutions, and those rights guaranteed in the European Convention on Human Rights (ECHR). |
