Notes: This essay appears in a collection that has been favourably reviewed in both the Harvard Law Review and the Notre Dame Philosophical Reviews. It makes a distinctive contribution by, among other things, identifying negligence law as being informed by a composite moral philosophy to which the name 'qualified deontology' is given. It also teases out of relevant case law a number of principles that might be used to mediate private and public concerns in the context of negligence law.
