Legal Points of Consideration for Online Teaching: A Guide for Teachers of Japanese Language A UK case study

Abstract

In this presentation, we will report on the background and contents of the guidelines for online teaching which are the product of the BATJ project, Raising Awareness of ICT Literacy for Japanese Language Teachers in the UK. It has been more than one year since the spread of Covid-19 brought about the sudden but unavoidable switch from classroom to online teaching. Throughout this time, institutions and teachers have been dealing with issues related to online teaching, such as varying time zones and student internet access. Under these circumstances, the authors and project members responsible for this presentation acted together to create an environment for the continued learning of students whose study abroad in Japan had been curtailed due to Covid-19, making available a new online platform, Inter-University Support Programme (IUSP). With the exception of Elly Darrah, who came to the project as a graduate of the University of Edinburgh’s MA Japanese programme, each of the project members was the Japanese Year Abroad Coordinator at their respective institution. Coming from seven UK universities, the latter all belonged to the Japan Year Abroad Programme (J-YAP) network established by Japan Foundation London in 2016. In this project, we present solutions to security and privacy issues related to establishing online courses with particular reference to areas of concern from the point of view of personal data protection. Having gathered questions and concerns surrounding General Data Protection Regulations (GDPR) and related points of consideration from those teaching online, we sought legal counsel relating to GDPR, before finally summarising our findings in a set of guidelines. The guidelines in question cover the following topics, focusing especially on data protection: 1) GDPR, Privacy Notices, Privacy Policies and Data Protection Impact Assessments (DPIA), 2) ICT and Privacy Guidelines for Japanese Language Teachers in the UK, 3) Copyright, 4) Inclusive Learning and Teaching, 5) Comparison of Online Platforms. Through these project guidelines, we hope to relieve some of the concerns surrounding security and privacy protection which can arise when managing online learning spaces.
