Abstract

Irish courts employ a doctrine of direct horizontal effect in respect of the fundamental rights set out in the Irish constitution. This chapter explores the relationship between constitutional rights and private law in Ireland and questions the relevance of methodological distinctions between direct and indirect horizontal effect.
